SAN FRANCISCO (AFP) – An American judge will hold a hearing Monday to address legal objections and witness interviews submitted by anti-torture and anti-war activists, some of whom have accused US intelligence officials of lying about the use of torture.
An open hearing before a federal judge in San Francisco in response to three lawsuits challenging the constitutionality of the controversial “enhanced interrogation techniques” is being convened at the request of the plaintiffs in the cases.
The three suits, brought by federal prisoners Shafiq Rasul, Mamdouh Habib and Asad Zamir, were filed two weeks ago by lawyers representing the American Civil Liberties Union, the Center for Constitutional Rights, and Human Rights First.
The plaintiffs alleged in their lawsuits that US officials committed war crimes and violated their rights under the US Constitution, by subjecting them to sleep deprivation, hypothermia and waterboarding.
The defendants include the Bush administration, former vice president Dick Cheney, CIA Director George Tenet and FBI Director Robert Mueller.
A spokesman for the US attorney’s office in San Francisco told AFP that the plaintiffs will be represented by private lawyers at Monday’s hearing and that the presiding judge, Charles R. Breyer, would not be making a decision on the suit.
Breyer — who was appointed by the Clinton administration in 1997 — is already familiar with the issues as they relate to the Guantanamo Bay detention camp.
Breyer had granted preliminary relief to Rasul and Habib, allowing them to remain free pending the outcome of the lawsuit.
But an earlier attempt by the Pentagon to moot the case by establishing a new set of rules, including 24-hour video monitoring of prisoners, failed last week when Breyer refused to grant a stay.
On Friday, the three plaintiffs met at the Loeb “Winchell 3” conference center in suburban San Francisco with former Republican presidential candidate Sen. John McCain — one of six US senators who in February sponsored legislation to ban enhanced interrogation methods.
“I met with the three of them, and they said that they were extremely relieved to find out that they had a lawyer and they could finally just talk to each other,” McCain told the AP.
